General Terms and Conditions
1. Application
These General Terms and Conditions (GTC) govern the mutual rights and obligations between the company I.B.O. Consulting Inh. Apaydin (hereinafter referred to as the “Agent”) and the parties requesting products and services (hereinafter referred to as the “Interested Party”). This applies especially to inquiries made via the Agent’s website, through which the Agent attempts to find suitable providers based on the Interested Party’s inquiry profile.
By using the Agent’s website, creating a customer profile, and/or submitting an inquiry, the Interested Party expressly agrees to these GTCs. Deviations require a written agreement or supplementary contracts.
2. Making an Inquiry
By submitting an inquiry via one of the Agent’s websites, the Interested Party enters into a contract for the brokerage of the requested products or services. Submission of an inquiry is non-binding and free of charge.
Only natural persons over 18 years of age and legal entities are eligible to submit inquiries. The Interested Party agrees to make only serious and truthful inquiries. The Agent reserves the right to delete non-compliant inquiries without giving reasons.
The Agent may contact the Interested Party to verify the data submitted and request further information via email or telephone.
3. Forwarding Inquiry Profiles
The Agent may forward the Interested Party’s contact details and inquiry profile to up to three partner companies in its network. By submitting an inquiry, the Interested Party authorizes the Agent to identify and forward their details to suitable partners.
There is no entitlement to the forwarding of the inquiry profile.
4. Receiving Offers
The Interested Party acknowledges that up to three partner companies may contact them based on their inquiry profile. Contact may be made via phone, email, or in-person appointment.
Partner companies may then submit offers. While the Agent seeks to ensure prompt and quality responses, it cannot guarantee the timing or receipt of offers.
The Agent does not act as a representative or contracting party between the Interested Party and any partner company. The Agent is not involved in the preparation of offers.
5. Evaluating Orders
The Agent may follow up with the Interested Party to inquire whether an offer was accepted and request feedback on the services provided.
6. Warranty and Liability
To the extent permitted by law, the Agent excludes liability.
The Agent merely facilitates contact between Interested Parties and partner companies. Any contracts resulting from this are concluded directly between the Interested Party and the partner company.
The Interested Party is solely responsible for reviewing any offers received. The Agent does not guarantee the accuracy or quality of the offers.
The Agent shall not be liable for damages resulting from submitted offers, subsequent contracts, or website usage.
The Agent also does not guarantee uninterrupted operation of its website.
7. Data Protection
The Agent will not pass data to third parties except to partner companies.
Partner companies may only use the data in connection with the specific inquiry and may not share or sell it further.
For Swiss users, data handling is in accordance with the Federal Act on Data Protection (FADP).
8. Amendments to the GTCs
The Agent may amend these GTCs at any time without prior notice.
9. Severability Clause
If any provision of this agreement is found to be invalid, the remainder of the agreement remains unaffected and in force.
10. Place of Jurisdiction and Applicable Law
The legal relationship between the Agent and the Interested Party is governed exclusively by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction is 6010 Kriens, Switzerland.
